JASON MONREAL POLICE SCHOLARSHIP FUND

In loving memory of their son Jason, his parents, Joe and Karen and his sister, Gina have created a scholarship program for the sons and daughters of Milwaukee Police Officers.

 

Who is Eligible for JMPSF?

Any child of a Milwaukee Police Officer is eligible to apply for scholarship funds. Applications can be obtained at the Milwaukee Police Association, 1840 North Farwell Avenue Suite 400, Milwaukee, WI. The applicant must be a graduating high school senior in 2000 or Spring of 2001 or be currently enrolled in an accredited college/university. Scholarship funds cannot be applied retroactively to semesters already completed.

How do Students Apply?

The Student must fill out the application in its entirety and drop off the completed application no later than November 1, 2000 at the Milwaukee Police Association, 1840 North Farwell Avenue Suite 400 between 8:30 am and 4:30 pm, Monday through Friday.

How Many Scholarships will be Awarded?

At a minimum, 4 scholarships will be awarded in an amount not to exceed $10,000.00 per scholarship. The actual amount not greater than $10,000.00 will be determined based on need identified through the application process.

How Is The Scholarship Paid?

All Scholarship awards will be paid to the student by December 31, 2000 for the academic year 2001. All donations (100%) made to the JMPSF will be awarded in the form of scholarships as stated above. Donations are tax deductible and can be mailed to the Milwaukee Police Association at 1840 North Farwell Ave. #400, Milwaukee, WI 53202.

Who Selects the Scholarship Winners?

A Screening Committee has been selected by the Police Officer Defense Fund, Inc., with the final selection to be made by Joseph, Karen and Gina Monreal.

To assist the PODF, Braeger Chevrolet at 4100 South 27th Street has donated a 2001 Chrysler "PT Cruiser," a large screen TV with a DVD Player and Midwest Express Airlines donated 2 Round Trip Tickets. The 3 donated gifts are currently being raffled at $5.00 per ticket or 5 for $20.00. Raffle tickets can be purchased at the Milwaukee Police Association 1840 North Farwell Avenue Suite 400 or the Milwaukee Police Supervisors Organization 2900 West Forest Home Avenue. The raffle winners will be drawn on Tuesday, December 12th, 2000, 12:30 PM at Serb Hall 5101 West Oklahoma Avenue at the MPA Christmas Party.

CONTRACT NEGOTIATIONS - On Tuesday, July 18, 2000 the Executive Board met with the City of Milwaukee. Both sides exchanged initial proposals and discussed the areas of importance/improvement. The next scheduled date for negotiations is Wednesday, August 16, 2000. As benefit provisions are agreed to, either existing or new, the Executive Board will post on the Bulletin Boards a comprehensive listing of all Articles that agreement has been reached and those Articles that remain open for further negotiations. Watch your Bulletin Boards for updates after each negotiation session.

OUT-OF-SHIFT PREMIUM - Article 15 "Overtime" of our labor agreement provides for time and one-half (1½X) pay for all hours worked outside of your regularly scheduled shift. Section 2.c. reads as follows:

"Overtime earned as a result of an authorized eight-hour shift assignment which falls outside the regularly scheduled eight-hour shift in whole or in part and which because of the nature of the work performed does not fall within 2.a. (training or roll call) or 2.b. (court time) above, shall be compensated at one and one-half (1½X) the base salary rate, except that if an employee's regularly scheduled eight-hour shift, as established by the Hours Of Work provision of this Agreement, is changed, then all time worked on the new regularly scheduled eight-hour shift shall be compensated at (1X) the base salary rate."

An example of interpreting this benefit is best described utilizing an Early Shift Officer as follows: If the 4:00P to 12:MID Shift is changed for any reason whatsoever for one day through and including nine days, and for illustration, the temporarily new scheduled shift is changed to 12:NOON to 8:00P for 9 consecutive work days, you are entitled to time and one-half (1½X) pay for each hour worked outside of the regular shift of 4:00P-12:MID. In this case the entitlement would be 1½X base for the 4 hours preceding the regular shift, which is 12:NOON to 4:00P for all nine days. In the event the 12:NOON to 8:P shift were to extend to a 10th consecutive work day you would lose entitlement to all Out-Of-Shift premium (the 1½X base). However, the lost entitlement can be recaptured if during the 10 consecutive day period you work overtime. For example, if on the 5th day you work 2 hours of overtime, from 8:P to 10:P, this will cause a break in the 10 consecutive day requirement needed by the department to deny Out-Of-Shift premium. The new entitlement would be: the first 4 days 12:NOON to 4:P would be paid at 1½X base, the fifth day 12:NOON to 2:P would be Overtime at 1½X base and 2:P to 4:P would be Out-Of-Shift premium at 1½X base, and the sixth through tenth days 12:NOON to 4:P would be paid at 1½X base. How to fill out your OT cards for the Out-Of-Shift premium can be found in the Rules and Procedures Manual Section 3/555.30 M.

IMPORTANT - No Advance notice of working out of your regular shift, whether it’s 7 days, 6 months or a year can eliminate the entitlement to the above Out-Of-Shift premium benefits. A number of supervisors have mistakenly confused Article 14 "Hours of Work" with Article 15 "Overtime." Article 14 reads as follows:

"Except on those occasions when an emergency situation exists, if the Department desires to change the off days falling within a single pay period for a member who otherwise continues to be assigned to the same schedule and off day group, the member must be given personal notice of such change, at least seven days prior to the start of the pay period in question. If the Department fails to give such notice, all hours worked on either of the off days in question shall be treated as falling outside the regularly scheduled eight-hour shift, as provided in Article 15."

This provision is limited to off days. The advance personal notice must be given 7 days prior to the 1st day of the pay period in which the off day(s) is changed. Any less than a 7 day personal notification entitles you to time and one-half (1½X) for all hours worked on the day you previously had scheduled as an off day. This 7 day personal advance notice for the change of an off day cannot be used to eliminate your entitlement to Out-Of-Shift premium on a work day under Article 15. If you have previously been informed otherwise by a supervisor, he/she is wrong. Please fill out your Out-Of- Shift premium OT cards and demand payment, even if the day(s) is long past.

 

GLOBAL SETTLEMENT - On July 14, 2000 Milwaukee Circuit Court Judge, the Honorable Michael Malmstadt, approved a revised schedule to implement the global pension settlement. The new schedule approved by the court is:

July 24, 2000 Mailing of notice/consent materials.

August 21, 2000 Date for returning consent forms.

September 1, 2000 Deadline for motions to intervene and for motions for certification of defendant class.

September 11, 2000 Parties to file cross-motions for summary judgment.

September 29, 2000 Response by parties to summary judgment motions.

October 9, 2000 Parties’ reply briefs on summary judgment.

October 20, 2000 Oral argument on summary judgment.

IMPORTANT

The informational packages containing the consent and waiver forms will be arriving in our mailboxes this week. It cannot be overstated or emphasized that the return of the consent documents in a timely fashion, will assist the court in staying within the above scheduling order. Encourage all our members and retirees to return it immediately.

PI-21/REPRESENTATION - Pursuant to Order No. 97-11, dated March 4, 1997, the Chief began oral interrogations of all officers, however remote, involved in an internal investigation. Except for emergencies or exigent circumstances, all officers are required to provide tape recorded oral interrogations/answers and will be provided at least a seven (7) day advance notice of the date the interrogation is to be conducted. Make every effort to contact the MPA office at 273-2515 the day you receive the PI-21 to facilitate representation.

In the adopted oral interrogation process, the Chief conducts an oral disciplinary interrogation immediately after a criminal investigation regarding an officer - involved shooting, allegation of excessive force, death in custody, or any other allegations of criminal misconduct. Because the internal immediately follows the criminal, it is imperative to use the same attorney in the criminal investigation and the internal investigation. Continuity of fact and circumstances is of utmost importance in the representation from criminal investigations.

As in the past, if you find yourself in one of the below listed situations, call an Executive Board member. Our phone numbers are in your calendar, and we will get Laurie or Jon on board as your counsel.

Involved in any shooting incident either directly or as a witness.

Involved in an incident where a perpetrator or civilian is seriously injured or dies.

Given a "Miranda" warning.

Arrested.

Subpoenaed to appear before a John Doe hearing or inquest.

Notified by the Fire and Police Commission of a citizen’s complaint.

You are advised to contact the MPA office at 273-2515 for representation.

Remember, if you want an attorney you must ask for one. State to the investigating officers "I don’t want to talk to anyone but my attorney and my Milwaukee Police Association Representative."

FLORIDA ATTRACTIONS - Planning a vacation to Florida? SIX FLAGS GREAT AMERICA - The MPA office has tickets at a reduced price - Regular Main Gate adult admission is $39.99 MPA price is $29.00, Children Main Gate admission is $19.99 MPA price is $19.50. Child admission is not by age but rather by height - anyone under 48" is considered a child. The park is open daily through August 27, Weekends and Labor day until September 17th. FrightFest begins October 7 through October 29 - weekends only. The MPA reduced tickets are only good until September 17th.
